Terms of Use

These Terms of Use ("Terms") govern your use of the SoberRise mobile application and website (collectively, the "Service") operated by SoberRise ("we", "our", or "us"). By accessing or using the Service, you agree to these Terms.

1. Health disclaimer

SoberRise is a support and tracking tool — it is not medical treatment, therapy, or a substitute for professional medical advice.

If you are experiencing alcohol withdrawal symptoms (including sweating, shaking, confusion, seizures, or severe anxiety), seek emergency medical attention immediately. Alcohol withdrawal can be life-threatening.

SoberRise does not provide medical advice, diagnosis, or treatment. Content in the app — including withdrawal timelines, health benefits, AI responses, and prevention suggestions — is for informational and supportive purposes only. Always consult a qualified healthcare provider about your sobriety journey, especially if you have a history of heavy or long-term alcohol use.

AI-generated responses may be inaccurate or incomplete. Do not rely on AI features for emergency or crisis decisions.

2. Eligibility

You must be at least 17 years old to use SoberRise. By using the Service, you confirm that you are at least 17 years old and have the legal capacity to enter into these Terms.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@96creativelabs.com if you suspect unauthorised access.

You may permanently delete your account in the app under Profile → Delete Account. Deletion removes your account and associated data as described in our Privacy Policy.

4. Free and Pro plans

SoberRise offers a free tier and a paid Pro subscription.

Free tier includes core recovery tools such as the sobriety counter, limited check-ins and journal entries, community access with daily limits, SOS support tools, withdrawal timeline, and selected milestones.

Pro subscription unlocks additional features such as AI coaching, Chat with Rise, buddy matching, Circles, craving forecast, advanced insights, unlimited usage in certain categories, and other premium features described in the app or on our website.

Feature availability may change over time. We will not paywall emergency SOS coping tools required for crisis support.

5. Subscriptions and billing

Pro subscriptions are billed through the Apple App Store (and, when available, Google Play). Current US pricing:

Prices are shown in the app before purchase and may vary by region, tax, or storefront currency conversion.

Where available, new subscribers receive a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, your subscription automatically converts to a paid plan and your Apple ID payment method is charged.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID account settings. Refunds are handled by Apple according to App Store policies, except where required by law.

Restore Purchases is available in the app for users switching devices or reinstalling.

6. Community guidelines

The SoberRise community, buddy, and Circles features are supportive spaces. You agree not to post or send content that:

SoberRise provides in-app tools to report, hide, and block content and members. We review reports within 24 hours, remove violating content, and may suspend or terminate accounts that break these guidelines. You may also contact hello@96creativelabs.com to report inappropriate activity.

7. User content

You retain ownership of content you create in SoberRise, including journal entries, posts, messages, photos, and voice recordings. By posting in community or Circles features, you grant us a limited licence to display and distribute that content within the Service as needed to operate those features.

We do not use your private journal entries for advertising or public display.

8. Acceptable use

You agree not to misuse the Service, including by attempting to reverse engineer the app, scrape other users' data, bypass subscription checks, or use the Service in a way that harms others or interferes with our infrastructure.

9. Intellectual property

All app design, code, branding, and content provided by SoberRise (excluding your user content) are owned by or licensed to SoberRise. You may not copy, modify, distribute, or reverse-engineer any part of the Service except as permitted by law.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of AI-generated content, or uninterrupted availability.

11. Limitation of liability

To the maximum extent permitted by law, SoberRise is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for Pro access in the 12 months before the claim arose, or $50 if you used the free tier.

12. Indemnification

You agree to indemnify and hold harmless SoberRise from claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to the Service or Terms

We may update the Service or these Terms from time to time. We will notify you of material changes through the app or by email. Continued use after changes become effective constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles, except where mandatory consumer protection laws in your jurisdiction apply.
